Kelly Toys and its Berkshire Hathaway -controlled parent company Jazwares have sued Build-A-Bear, saying its new “Skoosherz” toys copy the look and feel of their mega-popular Squishmallows products. Jazwares is seeking unspecified damages and for Build-A-Bear to stop selling Skoosherz products. It wants a declaratory judgement saying that the Squishmallow maker’s claimed trade dress rights are invalid and unenforceable. “If each aspect of the claimed trade dress were in fact protected trade dress, it would be virtually impossible for competitors to create alternative designs," Build-A-Bear added. It was the first time the plush products were offered to shareholders since Berkshire bought Alleghany in 2022 for $11.6 billion.

Hong Kong CNN —Japanese brand Uniqlo is suing Shein over claims the Chinese fast-fashion retailer is selling copycats of its viral shoulder bag. Its lawsuit against Shein was filed in Tokyo on December 28 and named three of the brand’s operators — Roadget Business Pte, Fashion Choice Pte and Shein Japan — according to the Fast Retailing statement. The shoulder bag first began circulating on TikTok in 2022 and continued to blow up in popularity through 2023, with video creators praising its versatility, spaciousness and affordability. The most viral TikToks about the bag racked up millions of views, ranging from styling tips to “what’s in my bag” videos, unboxings and haul reviews. In an investor report in the third quarter of 2023, Fast Retailer credited the shoulder bag for sparking “considerable interest on social media” and expanding its customer base among women and younger shoppers.

(AP) — Nashville Police Chief John Drake says he's “disturbed” over the unauthorized release of writings from the shooter who killed six people, including three children, at The Covenant School in March. Earlier Monday, conservative commentator Steven Crowder released what he said were three images of Audrey Hale’s writings from the day of the March 27 shooting. The news quickly sparked calls for an investigation as local and state leaders initially declined to verify the authenticity of the writings. Because of the lawsuits, police have since said they would await the direction of the court on whether to release Hale’s writings. Bill Lee said he has been “calling for clarity” around the Covenant shooter's writings for months, saying in a statement that he's been “frustrated” by the lack of transparency.

There’s no evidence fake Ozempic pens have been dispensed to patients from legal pharmacies and no indication any patients have been harmed, the EMA said in a statement. The fake pens were caught because they were packaged with real serial numbers that were flagged as inactive when the packs were scanned. “Check the patient information leaflet for Ozempic to see what the genuine Ozempic pens should look like,” the EMA said in its warning for patients. The fake pens were detected as Ozempic and similar medicines used for both diabetes and weight loss are in shortage in both the US and Europe. Both Novo Nordisk and Eli Lilly have filed lawsuits against medical spas, wellness centers and compounding pharmacies to stop them from selling what they call “unlawful” copycats.
